Do I need a trust if I already have a will?
Not always — but often, yes. A will goes through probate, which is public, time-consuming, and can be contested. A revocable living trust bypasses probate entirely, keeping your affairs private and making distribution faster. For most Florida homeowners, a trust is worth the investment.
What is a Lady Bird Deed and do I need one?
A Lady Bird Deed (Enhanced Life Estate Deed) lets you retain full control of your home during your lifetime — including the right to sell or mortgage it — while automatically passing ownership to your named beneficiaries at death, without probate. It also protects the home from Medicaid estate recovery in Florida. If you own a home and want it to go to your children, a Lady Bird Deed is often the smartest tool available.
When should I start Medicaid planning?
The earlier the better. Florida Medicaid has a 5-year lookback period for institutional care — meaning asset transfers made within 5 years of applying can cause penalties. Ideally, planning begins 5+ years before you anticipate needing nursing home care. That said, crisis planning is also possible and often more helpful than people expect.
What happens if a loved one becomes incapacitated with no documents?
Without a healthcare surrogate designation and durable power of attorney, family members may need to go to court for guardianship — an expensive, public, and time-consuming process. Having these documents in place avoids that entirely. It's one of the most important things you can do for your family.
